eSkill’s policy distinguishes between different user roles—clients (organizations), test takers (candidates), and website visitors. Clients who use eSkill to assess candidates retain ownership and control over the candidate data they collect through the platform. eSkill does not sell, rent, or distribute personal information except as required by law or as necessary to provide its services. Clients are responsible for ensuring that any additional data they collect via custom fields or assessments complies with all applicable laws and regulations.
eSkill supports data portability rights by global data protection laws such as the GDPR. Both clients and test takers have the right to request a copy of their personal data:
Test Takers: Can order a complete copy of their data at any time. eSkill will deliver this data within 30 working days, typically as spreadsheet files in Microsoft Excel format. Logical relationships between datasets are preserved using unique identifiers.
Clients: May have their data deleted by canceling their accounts. Upon request, eSkill will provide a copy of the client’s data before deletion.
If eSkill is acting as a data processor (i.e., handling data on behalf of a client), it will notify the data controller (the client) of any portability requests from data subjects without undue delay.
Clients: eSkill retains test-based information as long as the client’s account is active plus one year. After this period, data is removed and archived.
Test Takers: Information is kept as long as the client’s account is active plus one year. Test takers can request data removal at any time.
Website Visitors: Information is retained only as long as the visitor wishes to receive requested materials, with options to unsubscribe or request deletion at any time.

Tiered Plans: eSkill provides multiple subscription tiers—such as Foundation, Growth, and Scale—each tailored to different organizational sizes and requirements. These plans vary by features, customization options, and support levels, allowing organizations to select the most appropriate package and move between tiers as their needs change.
Flat-Rate and Per-Test Packages: Organizations can choose between flat-rate annual subscriptions (which allow unlimited or high-volume testing) and per-test-score packages, which are ideal for smaller or fluctuating hiring needs. This flexibility ensures that companies only pay for what they use and can easily increase or decrease their testing volume.
Seamless Transitions: Clients can upgrade to higher-tier plans for additional features (such as advanced customization or dedicated account management) or downgrade to basic plans if their hiring volume decreases. The transition between plans is managed smoothly, with support from eSkill’s account management team.
Top-Up Options: For organizations using per-test packages, it’s possible to purchase additional test credits as needed, with no minimum or maximum limits. This pay-as-you-go model is particularly useful for businesses with seasonal or unpredictable hiring patterns.
No Set-Up or Cancellation Fees: Many eSkill packages do not require long-term commitments, set-up charges, or cancellation fees, making it easy for organizations to adjust their usage without financial penalties.
Monthly and Annual Billing: Subscription plans are available with both monthly and annual billing options, giving clients further control over their budget and commitment period.
Scalable Architecture: eSkill’s cloud-based platform is built to handle increased user numbers, test volumes, and additional features without disruption, supporting organizations as they grow or restructure.
Automatic Renewal: After the initial contract term (as specified in the signed order), eSkill agreements automatically renew for successive periods equal to the original term unless either party provides written notice of non-renewal at least 30 days before the current term ends.
Fee Adjustments: eSkill reserves the right to adjust service rates and fees annually after the first 12 months. While increases are generally limited to 5%, eSkill may adjust fees as needed to stay competitive.
Overage Charges: If usage exceeds the agreed metrics (such as the number of test results), eSkill may charge an overage fee, typically $30 per additional test result unless otherwise specified.
Invoice and Payment: All fees are payable as outlined in the order, typically in USD, and are exclusive of applicable taxes. Payments are non-refundable regardless of actual usage, unless otherwise stated in the agreement.
Notice Requirement: Either party can terminate the agreement by providing written notice if the other party materially breaches the contract and fails to cure the breach within 10 days of receiving written notice. For breaches involving confidential information or intellectual property, the cure period is reduced to 2 days.
Non-Renewal: To avoid automatic renewal, either party must provide written notice of intent not to renew at least 30 days before the end of the current term.
Immediate Termination: eSkill may immediately terminate the agreement for uncured breaches that cannot be remedied, or for conduct likely to harm eSkill’s reputation or cause material damage.
No Refunds: Upon termination, clients are not entitled to credits or refunds for any unused portion of the agreement, except as expressly provided in the contract.
Account Cancellation: Clients may cancel their account by contacting their account manager. Data associated with the account is retained for up to one year after cancellation, after which it may be permanently deleted.
