The client (licensee) warrants that it owns or has the right to use the data it uploads.
Data Access and Portability: Upon written request from the client, Rapid Recon will return or destroy all Licensee Data, regardless of format (physical or electronic). Destruction will be certified in writing if requested. Rapid Recon may retain a copy of the data strictly for archival or compliance purposes. This right to retrieval or destruction of data applies upon contract termination or at the client’s request during service, ensuring data portability and client control.
Confidentiality: Rapid Recon is required to protect client data using commercially reasonable standards and can only disclose it to employees or agents on a “need to know” basis, under equivalent confidentiality obligations.
Rapid Recon offers flexible contract terms to allow organizations to scale their software usage up or down as their needs change:
Month-to-Month Renewal: After the initial term, Rapid Recon agreements automatically renew on a month-to-month basis. This gives clients the flexibility to adjust services and user counts without being locked into long-term commitments.
Cancellation and Adjustments: After the first 90 days and provided the account is current, clients may cancel with 30 days’ written notice. This flexibility enables organizations to reduce usage or terminate services as their business size or requirements fluctuate.
Additional Users or Locations: The agreement allows for the designation of “Permitted Users,” so organizations can increase or decrease their user base (e.g., by adding or removing employees, vendors, or locations) according to operational need.
