Data Ownership and Portability
Data Ownership: All data entered into VivifyScrum-such as projects, tasks, attachments, and user information-remains the property of the customer. You retain full ownership of your content.
Data Portability: Customers can typically export their data from VivifyScrum. This is usually possible through built-in export functions (like exporting boards, tasks, or reports in formats such as CSV or PDF) or by using the API. This ensures you can retrieve your information if you decide to switch to another platform or need a backup.
Account Termination: If your account is terminated, disconnected, or suspended (for example, due to non-payment), VivifyScrum does not guarantee the retention or integrity of your data after the event. It is the customer’s responsibility to export or back up important data before account closure or service interruption to prevent data loss.
Scaling Up / Down
Scaling Up: You can add more users or upgrade your subscription at any time as your team grows. This is managed through your account settings, and any additional charges are applied immediately. New features or increased capacity become available right away.
Scaling Down: If you need to reduce the number of users or downgrade your plan, you can do so through the account management interface. Subscription costs will decrease accordingly at the start of your next billing cycle.
No Refund Policy: VivifyScrum maintains a no-refund policy. Any fees paid in advance-whether monthly, quarterly, or yearly-are non-refundable, even if you scale down or cancel before the end of your paid term.
Service Continuity: Services remain active as long as payments are up to date. If payments lapse, your account may be suspended or terminated, and there is a risk of data loss if not addressed promptly.
The terms & conditions for contract renewal and cancellation
Contract Renewal:
The available information does not specify automatic renewal terms, but standard practice for SaaS platforms is that subscriptions renew at the end of each billing cycle unless cancelled by the customer.
Customers are responsible for ensuring payment is up to date; failure to pay may result in temporary denial of service or termination of the agreement. Any outstanding fees remain the customer’s responsibility, even after service interruption or termination.
Contract Cancellation:
Customers may cancel their account once any contract obligations have expired by providing thirty (30) days’ written notice to Vivify. This notice can be given via the contact form on the Vivify website.
Cancellation is only possible after the expiration of any existing contract term or obligation.
All payments made to Vivify are non-refundable, including setup fees and monthly fees, regardless of usage or the timing of cancellation.
There are no pro-rated refunds for unused service periods if you cancel before the end of your billing cycle.
If a billing dispute arises, it must be reported within thirty (30) days of the occurrence. Invalid chargebacks may result in service interruption and reconnection fees.
Upon cancellation, intellectual property owned by Vivify remains with Vivify, and customers should ensure they have exported any needed data prior to account termination.
Compliance
SOC 2 Compliance: VivifyScrum is compliant with SOC 2 standards, which focus on the security, availability, processing integrity, confidentiality, and privacy of customer data.
