Compliance and Legal Training:
Solutionreach implements a set of security measures to protect patient and practice data, with a strong focus on compliance and industry best practices. Here are the key security measures in place:
HIPAA Compliance:
Solutionreach operates as a business associate under HIPAA, meaning it is contractually obligated to protect protected health information (PHI) and follows strict administrative, physical, and technical safeguards required by HIPAA regulations.
They offer a Business Associate Agreement (BAA) to all covered entities to formalize these protections.
All sensitive data stored within the Solutionreach platform is encrypted to prevent unauthorized access.
Cloud-Based Security:
The platform uses cloud-based solutions with continuous monitoring by security experts, which can offer enhanced security compared to on-premise setups for many small healthcare practices.
Access Controls:
Solutionreach employs robust access controls to ensure only authorized personnel can access sensitive information.
Secure Document Management:
Features like the Secure Documents module allow practices to send, collect, and manage sensitive patient documents digitally with centralized e-signature capabilities and secure access for patients.
Privacy Policy and Fair Information Practices:
Solutionreach’s Privacy Policy outlines strict data handling and protection standards, and the company is committed to processing data securely and fairly.
CCPA Compliance for California Residents:
Solutionreach complies with the California Consumer Privacy Act (CCPA), providing California residents with rights to access, delete, or opt out of the sale of their personal information, and processes these requests securely.
Regular Security Monitoring:
Solutionreach’s Master Service Agreement (MSA) clarifies its policy on data ownership and portability:
Data Ownership:
According to the MSA, Solutionreach does not obtain any ownership right, title, or interest in the user content (i.e., data provided by clients or their patients). However, Solutionreach is granted a “royalty-free, worldwide, irrevocable, perpetual license” to use the user content as necessary to provide and improve its services.
Clients retain ownership of their own data and user content.
Privacy and Compliance:
Solutionreach’s terms and conditions for contract renewal and cancellation are outlined in its Master Service Agreement (MSA), Terms of Service, and related documentation. Here are the key data points:
Each Order Form has an initial term (“Order Form Initial Term”) as specified in the Order Form or, if not specified, coterminous with the MSA.
After the initial term, the Order Form may be renewed for additional terms (“Order Form Renewal Term”) as agreed between the parties.
Renewal is not automatic unless specified; parties must agree to renewal terms.
Renewal terms may involve renegotiation of service scope, pricing, and other conditions before a new Order Form is executed.
The MSA and Order Forms collectively govern the renewal and termination process.
To cancel a Solutionreach product, users must contact Solutionreach’s customer support team, provide account details, and express their intention to cancel.
The support team will guide users through the necessary steps, which may include terminating any active Order Forms under the MSA.
Users are responsible for understanding any potential fees or obligations associated with cancellation before proceeding.
Termination and Access
Upon termination of the MSA or any Order Form, the license to use Solutionreach materials expires, and the client must immediately cease using them.
Simply uninstalling the software or stopping payments does not void the contract or cancel the subscription; formal cancellation via support is required.
Auto-Renewal and Billing
Some customers have reported issues with auto-renewal and additional charges, highlighting the importance of clear communication and documentation when requesting cancellation or changes to service terms.
It is advisable to review the specific terms of your Order Form for auto-renewal clauses and to monitor billing statements closely.
Modifications and Termination by Solutionreach
Solutionreach reserves the right to modify or terminate services at any time, with or without notice, and may charge for new or existing features.
Users can stop using the services at any time if they do not agree with changes.
Payment Obligations
Clients must pay all one-time and recurring fees as specified in the Order Form throughout the term, including any renewal periods.
