These agreements ensure that Wingify processes data in compliance with applicable data protection regulations and does not claim ownership over the customer’s data.

• Data Portability

• Data Access and Export: VWO provides mechanisms for customers to access and export their data. Customers can request their data in a structured, commonly used, and machine-readable format, facilitating data portability. This allows customers to transfer their data to another service provider if needed.

• Data Subject Rights: Wingify supports data subject rights, including the right to data portability. Customers can submit requests to access, correct, or transfer their data. Wingify has procedures in place to handle these requests efficiently and securely.

• VWO Testing by Wingify allows for scaling up or down as organizational needs change:

• Centralized Testing: Centralizes testing across product, marketing, and development teams.

• Feature Test Control: Efficiently manage features and feature variables for testing by releasing them behind flags with on/off toggle switches.

• Contract Renewal

• Automatic Renewal: The agreement for VWO Testing automatically renews for additional, successive renewal terms if specified in the Order Form. The renewal will be on the same terms unless otherwise agreed in writing.

• Notice of Non-Renewal: Either party can provide written notice of its intent not to renew at least thirty (30) days prior to the end of the then-current term. The customer can send the notice of non-renewal by email to [email protected] or use the cancellation option within the Dashboard.

• Renewal Fees:

• For orders with a limited quota, the fees will increase by 10%.

• For orders with an unlimited quota, renewal fees will be based on the previous year's consumption, and the new pricing will be communicated to the customer. Both parties must mutually agree to renew services at the current price.

• Contract Cancellation

• Termination by Either Party: Either party may terminate the agreement if the other party commits a material breach and fails to cure it within 30 days of written notice. Non-payment of fees within the agreed due date is considered a material breach. Additionally, either party can terminate the agreement immediately if the other party becomes insolvent, files for bankruptcy, or if a notice or demand for winding up has been issued.

• Termination or Suspension by Wingify: Wingify may terminate or suspend the agreement immediately through written notice if it reasonably believes that the customer's use of the services violates any applicable law, rule, or regulation. During such suspension, the customer will not be able to access the services. Wingify will use commercially reasonable efforts to give advance written notice of the suspension unless directed otherwise by law enforcement or if suspension without notice is necessary to protect Wingify or its other customers.

• Customer Termination: Customers can terminate the agreement before the end of the term without liability if Wingify fails to provide the services in accordance with the terms of the agreement, causing material harm to the customer, and Wingify does not cure the failure within 10 days of receipt of notice. Customers must notify Wingify at least 30 days before the end of their term to cancel their account. Upon cancellation, customer data is deleted from Wingify's servers.

• Data Disposal: Upon termination or expiry of the agreement, or upon request, Wingify will delete user data within 45 to 90 days.

• SOC 2 Type II: This certification affirms that VWO has implemented controls to protect customer data based on the Trust Service Criteria for security, availability, processing integrity, confidentiality, and privacy.

• ISO 27001:2013: This international standard specifies the requirements for establishing, implementing, maintaining, and continually improving an information security management system (ISMS). VWO has received this certification, demonstrating its commitment to managing information security.

• ISO 27701:2019: This standard provides guidelines for establishing, implementing, maintaining, and continually improving a privacy information management system (PIMS). It is an extension to ISO 27001 and ISO 27002 for privacy management within the organization's context.
