Liine implements a robust suite of security measures to protect user data, particularly important given its focus on healthcare, dental, and veterinary practices where sensitive information is routinely handled.
HIPAA Compliance: Liine is designed to meet HIPAA requirements for covered entities and business associates handling protected health information (PHI). The platform offers a HIPAA Business Associate Addendum (BAA) that outlines specific responsibilities for protecting PHI, including encryption, access controls, and breach notification protocols.
Encryption: Liine encrypts electronic PHI both in transit and at rest, ensuring that data is protected from unauthorized access.
Access Controls: The platform implements strict access controls so that only authorized personnel can access sensitive data. Access is limited based on user roles and the principle of least privilege.
Security Policies and Procedures: Liine maintains reasonable and appropriate administrative, technical, and physical safeguards to protect the confidentiality, integrity, and availability of PHI. This includes policies to prevent unauthorized access and to safeguard data from accidental or malicious loss or disclosure.
Breach Notification: In the event of an actual or suspected breach of PHI, Liine is required to promptly notify affected customers and provide details about the incident, including the individuals affected and the nature of the data involved.
Confidentiality Agreements: All employees and contractors are bound by confidentiality agreements to protect customer information. Confidentiality obligations remain in force for two years after the termination or expiration of the service agreement.
Data Integrity and Availability: Liine takes measures to ensure data integrity and availability, including regular backups and safeguards against accidental destruction or loss.
Liine’s policy on data ownership and portability is clearly outlined in its Terms of Service and aligns with industry best practices and regulatory requirements for healthcare technology:
Data Ownership: As between Liine and its customers, the customer retains all ownership rights to their content and protected health information (PHI). Liine does not obtain any ownership interest in the customer’s data beyond the limited, non-exclusive license required to provide the software and services. All information, data, and content uploaded or collected through Liine remains the property of the customer, except for aggregated and de-identified data used by Liine for broader analytics and improvement purposes.
Data Portability: Liine is committed to making PHI and other customer data available upon request. If a customer requests their PHI, Liine must provide it within ten days. If an individual (such as a patient) requests PHI directly from Liine, Liine will forward the request to the customer (the healthcare provider) within ten days. This ensures that customers can access and, if necessary, export their data for use elsewhere, supporting data portability.
Aggregated and De-identified Data: Liine may use aggregated and de-identified data derived from customer information for analytics, improvement, and other business purposes. This data is stripped of personally identifiable information and cannot be linked back to individuals or specific customers.
Liine terms and conditions for contract renewal and cancellation are detailed in its official Terms of Service. Below are the key data points regarding renewal and cancellation:
Initial Term and Renewal: The contract begins with an initial term specified in the Order Form. After this term, the agreement automatically renews for the period outlined in the Order Form (the "Renewal Term"), unless either party provides written notice of non-renewal at least 30 days before the end of the current term.
Notice of Non-Renewal: To prevent automatic renewal, either party must notify the other in writing at least 30 days before the expiration of the current term. For customers, notice must be sent by email to the address identified by Liine for this purpose.
Termination for Material Breach: Either party may terminate the contract if the other party materially breaches the terms and conditions. The breaching party has 30 days to cure the breach after receiving written notice. If the breach is not cured within this period, the non-breaching party may terminate the agreement.
Termination by Liine: If the software becomes subject to an infringement claim, Liine may, at its sole discretion, modify or replace the software to resolve the issue, or terminate the agreement and provide a refund if the issue cannot be resolved.
Payment Obligations Post-Termination: All payment obligations up to the date of termination survive the end of the agreement. If a payment is not successfully settled, the customer remains responsible for any uncollected amounts, and Liine may continue to bill the payment method on file.
Survival of Certain Provisions: Key sections regarding payment, confidentiality, warranties, limitation of liability, indemnification, and other critical terms remain in effect even after termination of the agreement.
Entire Agreement: The Terms of Service, Order Form, and (where applicable) Business Associate Agreement constitute the entire agreement between the parties and supersede all prior agreements and understandings.
