Customer Ownership of Machine Level Data: Any operational or machine data provided to PEAK by the client’s building management system (“Machine Level Data”) is explicitly acknowledged as the property of the customer. PEAK (CIM) does not claim ownership over this data.
License for Operational Use: By using the platform, customers grant CIM a non-exclusive, royalty-free license to use, process, analyze, and store their Machine Level Data. This is strictly for delivering contracted services, platform improvements, and data analytics. Ownership is not transferred—CIM’s rights are limited to facilitating service delivery and continuous platform enhancement.
Creation of Aggregated/Derived Data (CIM Data): Any aggregated datasets, analyses, or insights produced by PEAK through the compilation and processing of customer data (CIM Data) remain the exclusive intellectual property of CIM. This means while you own your raw and source data, analytical outputs and derivative “CIM Data” are owned by CIM.
Confidentiality: Client data is treated as confidential, and both parties have strong obligations not to disclose confidential information outside of the purposes outlined in the agreement, unless required by law.

The terms and conditions for contract renewal and cancellation for PEAK by CIM, based on their official agreements and terms documentation:
Initial and Renewal Terms: When you sign up, you agree to an "Initial Term" (the length of your first contract period, e.g. 1 year). After the Initial Term ends, your subscription automatically renews for successive "Renewal Terms" (defaults to your original contract length or as set in the proposal).
Notice Period for Non-Renewal: Either PEAK (CIM) or the customer can prevent renewal at the end of any term by providing written notice. For most direct customer contracts, the standard minimum notice is 30 days before the end of the current term. For some service provider contracts or U.S. partnerships, the notice period is 90 days.
Fee Adjustments: After the Initial Term, CIM may increase subscription fees by providing at least 30 days’ written notice. Fee increases are typically tied to a Consumer Price Index (CPI) plus an additional percentage, or as specified in your agreement.
Ongoing Services: If neither party gives notice by the required deadline, the contract will simply continue into the next Renewal Term under the same terms, subject to any notified fee changes.
How to Cancel: Submit a written cancellation request (usually by email) to CIM. The cancellation will not take effect until the end of the current (Initial or Renewal) Term, unless the contract or law allows earlier termination.
Notice Period: After the Initial Term, you can terminate at the end of a Renewal Term by providing at least 30 days’ (or 90 days for certain U.S. partners) written notice before the end of that term.
Early Termination by Material Breach: Either party may terminate the contract earlier if the other party commits a material breach (e.g. repeated non-payment or other significant contract violations) and fails to remedy it within 10 business days of written notice.
Insolvency or Force Majeure: The agreement can also be terminated if either party enters administration, liquidation, or faces other insolvency situations, or in major “force majeure” events outside either party’s control.
CIM’s Right to Terminate Early: CIM may terminate with 30 (or 90) days’ notice if it can no longer receive the required data from your systems, or if its business undergoes significant adverse changes (ownership, operation).
Refunds: If CIM terminates early for reasons not involving customer breach, CIM will refund any prepaid fees, prorated for the unused portion of the subscription.
Suspension for Non-Payment: CIM may suspend your access to PEAK if your fees are overdue, with late interest accruing on unpaid balances.
