Data Portability: If you wish to transfer your data to another system or provider, MYR POS will provide your information in a commonly used electronic format upon request. This makes it easy to move your business data as needed.
Data Deletion: You may request deletion of your data when there is no longer a valid reason for MYR POS to process it, or if there is no legal basis for retaining it. MYR POS will delete or de-identify your data as soon as reasonably possible, although some information may remain in backup or archived copies for legal or operational reasons.
Scaling Up / Down
Subscription Model: MYR POS operates on a subscription basis, with terms set out in your agreement (monthly or yearly).
Scaling Up: If your business grows and you need to add more locations, terminals, or features, you can adjust your subscription accordingly. Fees will be updated based on the new services, and MYR POS will provide advance notice (typically at least 30 days) of any fee changes before your renewal.
Scaling Down or Termination: To reduce your service level or terminate your subscription, you must give written notice at least 30 days before the end of your current subscription term. Early termination is generally not allowed before the end of the initial term, except in special cases outlined in your agreement.
Automatic Renewal: Subscriptions automatically renew for additional terms unless you provide notice to cancel or change your plan. This system ensures your service continues seamlessly, and you can scale your subscription as your needs change.
The terms & conditions for contract renewal and cancellation
Initial Term: The contract begins on the activation date specified in your subscription and lasts for the number of months or years detailed in your agreement.
Automatic Renewal: After the initial term, unless otherwise stated, the contract automatically renews on a yearly basis. This is referred to as the "Renewal Term." Both the initial and renewal terms together make up the full contract duration.
Notice for Non-Renewal or Cancellation: Either the customer or MYR can terminate the agreement by providing written notice at least 30 days before the end of the initial or current renewal term.
Early Termination: Customers generally cannot terminate the agreement before the end of the initial term, except in cases of material breach as outlined in the agreement.
Termination for Breach: If either party materially breaches the agreement, the non-breaching party can issue a written termination notice. If the breach is not cured within 30 days, the agreement terminates automatically. For certain serious breaches (such as non-payment or confidentiality violations), MYR can immediately suspend or terminate access.
Suspension: MYR may suspend access immediately if required by law, if a breach is not remedied within 15 days of notice, or if there is a security or privacy risk.
Effect of Termination: Upon termination, the customer must stop using the product. MYR may immediately deactivate the account and delete customer data, and is not liable for any loss resulting from such termination. Outstanding fees remain payable.
Refunds: All payments are non-refundable.
Fee Changes: After the initial term, MYR may increase fees with at least 30 days’ written notice before the start of a new renewal term.
