CompostManager’s public documentation does not provide a detailed, standardized contract for renewal and cancellation. However, based on industry practices and available information, the following key points summarize what is typically offered or should be clarified when engaging with CompostManager:
Automatic Renewal: Many composting service contracts, including those for software like CompostManager, are structured with automatic renewal clauses. Unless otherwise specified, subscriptions may renew for the same term as the original agreement unless notice is given by either party before the renewal date.
Notice Period for Non-Renewal: It is common for either party to be required to provide written notice of non-renewal within a specified period (often 15–30 days) before the end of the current term. The exact notice period should be confirmed in your agreement.
Amendments and Extensions: Contract terms, including renewal periods and pricing, may be amended by mutual written agreement. Extensions beyond the original term are typically possible if both parties agree in writing.
Termination by Either Party: Contracts often allow for termination by either party, usually with written notice. The required notice period and any associated fees or penalties should be specified in the agreement.
Termination for Cause: Either party may terminate the contract for cause, such as a material breach of terms, failure to pay, or insolvency. The breaching party is typically given a period (e.g., 30 days) to remedy the breach before termination becomes effective.
Refunds and Outstanding Payments: If the contract is terminated early, the agreement should specify whether any prepaid fees are refundable and whether outstanding payments are due for the remainder of the term.
CompostManager is designed to help composting operations meet key industry, environmental, and data protection compliance standards. The platform’s software and hardware support legal and quality requirements for composting facilities, particularly in the UK and Europe.
Industrial Emissions Directive (IED) 2010/75/EU: CompostManager supports compliance with the IED, which regulates pollutant emissions from industrial installations. The software enables monitoring and control of critical composting parameters (temperature, moisture, oxygen, carbon dioxide) as required by the directive.
Best Available Techniques (BAT36) for Waste Treatment: The system is specifically designed to comply with BAT36, a key conclusion under the IED. BAT36 mandates regular assessment and control of composting parameters to minimize environmental impact and optimize process efficiency. CompostManager automates the collection and analysis of these parameters, providing actionable instructions and audit-ready records.
PAS100 (Publicly Available Specification 100): CompostManager enables compliance with PAS100, the UK’s leading specification for composted materials. PAS100 covers the entire composting process, from input materials to quality control and laboratory testing, ensuring that compost products meet strict quality and safety criteria. The software generates compliance reports and maintains traceable records for audits.
GDPR (General Data Protection Regulation): The platform aligns with GDPR requirements, providing users with rights to access, rectify, erase, and export their personal data. Data is stored securely in the cloud, and users can contact a Data Protection Officer for privacy-related requests.
Automated Data Collection & Reporting: Ensures all required parameters are monitored and recorded for compliance and audit purposes.
Traceability: Each compost batch is registered and tracked with unique barcodes, supporting full traceability as required by PAS100 and BAT36.
Audit-Ready Records: Cloud-based storage and reporting tools facilitate easy access to historical data for regulatory inspections.
