Renewal Process: SmartMon contracts, like most SaaS and MES/OEE software agreements, typically specify a fixed initial term (e.g., annual or multi-year) with provisions for renewal. Renewal may occur automatically unless either party provides written notice of non-renewal within a designated period, commonly 30 to 90 days before the contract’s expiration.
Notification Period: The contract will specify the required notice period for non-renewal. If neither party gives notice, the contract may auto-renew for an additional term under the same or updated terms and conditions.
Renegotiation Window: Before renewal, both parties often have the opportunity to renegotiate terms, including pricing, features, user licenses, and service levels. This allows the agreement to reflect any changes in business needs or operational requirements.

Effects of Termination: Upon termination, access to SmartMon is revoked. The provider is obligated to return or securely delete all customer data, except where retention is required by law. Customers can request data export before deletion to ensure data portability.
Refunds: If termination occurs due to SmartMon’s uncured material breach, the customer may be eligible for a refund of prepaid fees for the unused portion of the subscription. If the customer terminates for their own breach, unpaid fees for the remainder of the term may still be due.
