Opensense uses a comprehensive set of security practices to safeguard customer information:

• Data Encryption: All data sent to and from Opensense is encrypted using strong protocols (TLS 1.2 or higher). Data stored on servers is also encrypted with 256-bit ciphers, ensuring confidentiality and integrity at all times.

• Secure Data Centers: Customer data is hosted in highly secure, US-based Tier 1 SOC 2 Type II data centers. These facilities have 24/7 security, surveillance, and strict physical access controls.

• Server Security and Monitoring: Servers are centrally managed according to established security guidelines and are monitored continuously for any signs of unusual activity. Intrusion detection and prevention systems are in place to help identify and respond to threats.

• Access Controls: Access to Opensense systems is tightly managed. User accounts are provisioned carefully, with support for single sign-on (SSO) using providers like Okta or Google, multi-factor authentication (MFA), and role-based access controls (RBAC). Only those who need access are granted it.

• Confidentiality and Compliance: All employees and contractors with access to personal information are bound by confidentiality agreements. Opensense complies with major privacy regulations such as GDPR and CCPA and processes data only as needed to deliver its services.

Data Ownership:

• Customers retain ownership of their data. Opensense acts as a service provider or processor, handling personal information only as instructed by the customer and solely for the purpose of delivering the contracted services.

• Opensense does not sell, use, or disclose customer data for any purpose other than providing the agreed-upon services. The company certifies that it will not use customer data outside of the direct business relationship, nor for any commercial purpose beyond service delivery.

Data Portability:

• Customers have the right to access, update, correct, or delete their personal information held by Opensense. If a customer requests, Opensense will provide information about whether any personal data is held or processed on their behalf.

• Upon termination of services, Opensense will delete or return personal data to the customer, except where retention is required by law. Data is typically retained for up to seven years after termination for potential account reactivation, but confidentiality and use restrictions remain in effect during this period.

• Opensense supports data portability, enabling customers to obtain their data in a usable format if they wish to transfer it to another provider or system.

Scaling Up:

• Opensense is designed to scale easily with organizational growth. Customers can add users, increase campaign volume, or expand to additional regions or business units without major friction. Integrations and management are handled at the server or platform level, allowing for rapid deployment across thousands of users or multiple global variations.

• There is no need to set up licenses or install software one by one; changes can be made centrally, making it straightforward to accommodate organizational expansion.

Scaling Down:

• Customers can reduce the number of users or campaigns as needed. While scaling up is seamless, scaling down may require review to ensure that minimum contractual commitments or pricing tiers are maintained, as subscription plans may have minimum user or spend requirements.

• Adjustments to service levels, user counts, or features can typically be managed through the admin console or by contacting Opensense support. Any changes in service scope should be reviewed in the context of the customer agreement to ensure compliance with contractual obligations.

Contract Renewal:

• The Opensense contract typically begins upon acceptance and remains active until all purchased services expire or are terminated.

• Renewal terms are usually outlined in the original agreement or order forms. In most cases, services automatically renew at the end of the current term unless either party provides advance written notice of non-renewal, as specified in the contract.

• Renewal pricing and terms may be subject to adjustment, which should be reviewed before the renewal date.

Contract Cancellation (Termination):

• Termination for Cause: Either party may terminate the agreement with written notice if the other party materially breaches its obligations and fails to cure the breach within 30 days of receiving notice. If the breach cannot reasonably be cured within 30 days (excluding payment defaults), termination may occur after 30 days if substantial remedial action has not started. Termination is also possible if a party becomes insolvent or enters bankruptcy.

• Refunds and Payments: If the customer terminates for cause, Opensense will refund any prepaid fees covering the remainder of the term after the termination date. If Opensense terminates for cause, the customer must pay any outstanding fees up to the effective termination date. Termination does not relieve the customer of paying any fees due prior to the termination date.

• Data Access and Portability: After termination, customers have 30 days to access and export their data. After this period, Opensense is not obligated to retain or provide access to customer data and will delete it unless retention is required by law. Customers are responsible for exporting their data within this window.

• Surviving Provisions: Certain terms, such as confidentiality, payment obligations, proprietary rights, indemnification, limitation of liability, and data export provisions, remain in effect even after the agreement ends.
