IBM Databand contract renewal and cancellation terms are governed by IBM’s standard software agreement processes, with several key points relevant to customers:
Contract Renewal:
Renewal terms are specified in the original sales agreement and indicate whether each contract line is renewable and when it can be renewed. Each line can be renewed individually, or multiple lines can be coterminated and renewed together.
For IBM Software Subscription and Support (S&S), including Databand, renewals typically occur annually on a set “Anniversary” date for Passport Advantage Sites, or are based on transaction dates for Passport Advantage Express.
IBM sends renewal reminders at 60, 45, 30, and 15 days before the renewal date, or until the renewal is completed.
Renewal can be completed online via Passport Advantage, through an IBM Renewal Representative, or an authorized IBM Business Partner.
In many cases, contracts are set to automatically renew at current charges unless you provide written notice of non-renewal before the expiration of the term. If you do nothing, the contract (including support and licenses) may renew automatically, and you will be invoiced accordingly.
If you choose not to renew, you must notify IBM of your intent before the renewal date, either online or in writing. Failing to renew means losing access to upgrades and support; reinstatement later is possible but typically incurs a higher fee than the standard renewal rate.
Contract Cancellation/Termination:
Contracts can be terminated at any time, either immediately or on a scheduled future date. When terminated, the contract status changes to “Terminated,” and no further actions (amendments or renewals) can be taken on that contract.
If termination is scheduled for a future date, the contract enters “Termination Pending” status, during which notifications are sent and amendments can still be made until the actual termination date. Once terminated, the contract is closed and cannot expire or be amended.
Notifications about contract termination are sent to specified users if configured in the system.
A terminated or Termination Pending contract can sometimes be restored to its earlier status if required, depending on the administrative setup.
